The commission of Inquiry on Enforced Disappearance PDF Print E-mail

The Commission of inquiry for the Enforced Disappeared has started working since 10th May 2010. The chairman of the Commission is Justice retd. Kamal Mansoor Alam , one member is justice retd  Fazulur Rehman and another is Justice retd. Nasira Iqbal. It was formulated by the Government keeping in view the desperation of the families and miseries of the Enforced Disappeared since 9/11. Also keeping in view that the Honorable Supreme Court cannot give this highly sensitive and volatile issue enough time upon daily basis. The Commission is going to proceed on daily basis and pass on final orders and directions to the authorities on the spot .The Expectations are high and the powers given to the  Commission are good enough to tackle the issue effectively.

The Honorable Supreme Court is going to monitor its working and the report it is going to submit at the end . The Commission is bound to submit its report within 4 months of its notification. In the first phase the Commission met with Human Rights Defenders ( Amina Masood Janjua , Asma Jehangir  and Nasrullah Bangalzai)  and Lawyers , then met with Government Functionaries like secretaries of relevant Ministries and listened to the top of the list  5 cases of the Enforced Disappeared Pakistanis belonging to Rawalpindi, Islamabad  and lahore etc ( Masood Janjua, Faisal Faraz , Atiqur Rehman, Muhammad Ali and Tahir Farooq.)

In the second phase the Hearings with the Enforced Disappeared of Baluchistan and Sind will be  conducted by next week in Karachi. 21st May to 23rd May 2010. It is also mentioned in the mandate of the commission that it can hold inquiry, take statements  from the released persons, fix the responsibility ,hold accountable the authorities involved and arrange compensation for the aggrieved victim families of the Enforced Disappeared.

Defence of Human Rights Pakistan has already forwarded its written recommendations to the Honorable Commission.

Subject: Earnest request to find Masood Janjua and other missing loved ones in Pakistan.
Honorable Sir,
I congratulate you on becoming the President-Elect of the United States. If I was able to cast a vote, I
would certainly cast in your favor because you give a new sense of hope to many people around the world. I
know for you and for all Americans, family means “The Most” in your life. Similarly, family means the most to
me and to all Pakistanis’. My letter today is all about “family and their loved-ones”.
My husband Masood Janjua is the most loving and vital part of our family. We got married in June 1989
and since then had all the happiness in the world. With two sons and a daughter, our life was full of love and
fun. But our lives changed on July 30, 2005 when Masood was abducted on his way to Peshawar for a business trip. The love of my life was snatched away from me without any reason and I am left all alone to
suffer,struggle and grief for my husband. In spite of trying hard and approaching the highest level personnel in Pakistan, I am still desperate and clueless for any news about Masood for over three years. Recently Aasim Qureshi, a UK based International Lawyer of Cage-Prisoners held a press conference in Pakistan on December 4, 2008 telling that he talked to senior military officials in Pakistan and was informed that Masood is detained in Pakistan and could not be released because of the CIA’s involvement.

    Recommendations to the Honorable Commission
    I am not just suggesting to the Commission, but in fact I am  talking to the World trying to shake its conscience:
    “A society can exist on Infidelity but it can not exist on Injustice.”

The unfortunate incident of 9/11 paved the way for more unfortunate Human Rights violations , illegal abductions ,arrests and tortures imposed upon the honorable citizens of Pakistan.Our Ex Minister of Interior Aftab Sherpao admitted in a Seminar in UK (April 18th 2007) that we have arrested 4000 regarding “War on Terror”and handed over 2000 to foreign agencies. Ex President Musharraf admits in his Biography(In the Line of Fire) that 689 have been arrested for whom bounties of Dollars have been taken. Our poor Nation was forced to fight an alien War becoming a worst target of Terrorism itself, unfortunately the real culprit behind all this was never stopped or held accountable.
Highly condemnable under all laws of the World and in the United Nations charters as a “Crime” , the unlawful abductions and mysterious disappearances are on the rise and continue to haunt our beloved Homeland, even in the present Democratic set-up of the Government. Be it one or one thousand or one hundered thousand ,it is equally unjust, harmful and damaging to the dignity of an Honorable Nation.

A Press Conference was held today 23rd of May 4 pm , in the National Press club Islamabad, regarding the new cases of abduction taking place.In recent days as many as 6 / 7 cases have been reported to DHR,
as law of the jungle prevails in the country. Amina Masood Janjua made a special appeal to the Chief Justice of Pakistan ,that Heavens have fallen on the aggrieved families of Missing Persons,  kindly take
Suo-motto notice and grant  us Justice we deserve as Honorable Citizens of Pakistan.
